Welcome to The Algorithm (“the App”), operated by Thought Co (“we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your use of the App and any content, projects, or services made available through it. By creating an account or using the App, you agree to these Terms.
If you do not agree, do not use the App.
1. What The Algorithm Is
The Algorithm is an intentional, in-person art sharing platform. It provides access to curated, artist-led projects that are experienced privately and deliberately.
Projects are not publicly discoverable. Access is granted explicitly through the App (for example, via purchase, invitation, or direct sharing).
2. Accounts and Authentication
To use the App, you must create an account and authenticate using a supported third-party provider (such as Google).
You are responsible for:
- Maintaining the security of your account
- All activity that occurs under your account
We may suspend or terminate accounts that are used in violation of these Terms or in a way that compromises the integrity or security of the system.
3. Access Grants and Licensing (Important)
Access to projects and content in the App is provided as a personal, revocable license, not a transfer of ownership.
This means:
- Access grants allow you to view or experience content within the App
- Access does not grant ownership of the content
- Access may be limited, expire, or be revoked
Access grants are:
- Personal to your account
- Non-transferable, except through explicit in-app sharing mechanisms
- Subject to verification and enforcement on our servers
We reserve the right to revoke access in cases including (but not limited to):
- Expired or invalid grants
- Refunds or payment reversals
- Abuse, misuse, or attempts to bypass access controls
- Legal or contractual requirements
4. Content Usage Restrictions
Unless explicitly stated otherwise by the artist or project owner, you may not:
- Redistribute, resell, sublicense, or publicly exhibit content
- Share private or time-limited access links outside the App
- Attempt to copy, download, scrape, or extract protected assets
- Circumvent or interfere with access controls or security mechanisms
Content is provided for personal, private experience only.
5. Payments and Purchases
Some projects may require payment to unlock access.
When you make a purchase:
- You are purchasing an access license, not ownership
- Payments are processed by third-party providers (such as Stripe)
- Refunds, disputes, or chargebacks may result in loss of access
We are not responsible for errors or outages caused by third-party payment providers.
6. Availability and Changes
We aim to provide a stable, long-lived platform, but we do not guarantee that:
- Any specific project will remain available indefinitely
- Content will remain unchanged
- The App will be uninterrupted or error-free
Projects, features, and infrastructure may evolve over time. Where possible, changes are made deliberately and with respect for existing access.
7. Prohibited Conduct
You agree not to:
- Use the App for unlawful purposes
- Attempt to gain unauthorized access to systems or content
- Interfere with the App’s operation or security
- Use the App in a way that harms artists, other users, or the platform
8. Third-Party Services
The App relies on third-party services (including authentication, payments, and content delivery).
We are not responsible for:
- Third-party service outages
- Changes to third-party terms or availability
Your use of those services may be subject to their own terms and policies.
9. Disclaimer
The App and all content are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the App or inability to access content.
11. Termination
You may stop using the App at any time.
We may suspend or terminate access if you violate these Terms or if continued access poses legal, security, or operational risk.
12. Governing Law
These Terms are governed by the laws of Indiana, USA, without regard to conflict of law principles.
